Welcome to PipeBill. These Terms of Service ("Terms") govern your use of our invoicing software service. By accessing or using PipeBill, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our service.
1. Acceptance of Terms
By creating an account and using PipeBill, you confirm that you are at least 18 years old and have the legal capacity to enter into this agreement. If you are using PipeBill on behalf of a business or entity, you represent that you have the authority to bind that entity to these Terms.
2. Description of Service
PipeBill provides cloud-based invoicing and payment processing software specifically designed for plumbing businesses. Our service allows you to create invoices, manage customers, send invoices via email or SMS, and accept online payments.
3. Account Registration
To use PipeBill, you must register for an account. You agree to:
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account
4. Subscription and Payment
Free Trial: We offer a 14-day free trial period. No credit card is required during the trial period.
Paid Subscription: After your trial period ends, you must subscribe to a paid plan to continue using PipeBill. Subscription fees are charged monthly in advance and are non-refundable.
Payment Processing: If you choose to accept online payments, payment processing fees apply as outlined on our Pricing page. These fees are charged by our payment processor (Square) and are separate from your subscription fee.
5. Cancellation and Refunds
You may cancel your subscription at any time from your account settings. Cancellations take effect at the end of your current billing period. We do not provide refunds for partial months or unused portions of your subscription. Your data will remain accessible for 30 days after cancellation, after which it will be permanently deleted.
6. Acceptable Use
You agree to use PipeBill only for lawful purposes. You may not:
• Violate any laws or regulations
• Infringe on intellectual property rights
• Transmit viruses, malware, or harmful code
• Attempt to gain unauthorized access to our systems
• Use our service to send spam or unsolicited communications
• Engage in fraudulent activities or money laundering
7. Your Data and Privacy
You retain ownership of all data you input into PipeBill, including customer information and invoice data. We will not sell, share, or use your data except as necessary to provide our service or as required by law. Please review our Privacy Policy for more information about how we handle your data.
8. Intellectual Property
PipeBill and all related trademarks, logos, and content are owned by us or our licensors. You may not copy, modify, distribute, sell, or lease any part of our service or software without our written permission.
9. Service Availability
While we strive to provide reliable service, we do not guarantee that PipeBill will be available 24/7 without interruption. We may perform maintenance, updates, or experience technical issues that temporarily affect service availability. We are not liable for any loss or damage resulting from service interruptions.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PIPEBILL AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF YOUR USE OR INABILITY TO USE OUR SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
11. Warranty Disclaimer
PIPEBILL IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED.
12. Indemnification
You agree to indemnify and hold harmless PipeBill, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of our service, your violation of these Terms, or your violation of any rights of another party.
13. Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify you of significant changes via email or through the service. Your continued use of PipeBill after changes take effect constitutes acceptance of the updated Terms.
14. Termination
We may suspend or terminate your account if you violate these Terms, fail to pay subscription fees, or engage in activities that harm our service or other users. Upon termination, your right to use PipeBill immediately ceases, and we may delete your data after the 30-day grace period.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts located in [Your Jurisdiction].
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
17. Entire Agreement
